Property Management and Investor Information: February 2008

In my first few years in the property management business I noticed that the company I worked for went through a lot of different vendors.  The problem was that the property management company was a "slow pay" client.  The work would get completed then the property manager had to collect the rent, or worse, rent the property, then the vendor could get paid.  Since there were often multiple vendors involved, some vendors would not get paid for 45-90 days.  This is a sure fire way to put a vendor out of business.  It is also a sure fire way to have the vendor raise prices to cover the late pay habit.

I decided that as soon as I had my own business I would try to control that process better.  First, get the money up front and hold it in the property trust account.  Second, hire my own handyman so I could control the priorities of  the day.  As I grew the business even bigger, it become a real luxury to have my own crews for plumbing, painting, and handywork.  In fact, it became a neccesity to have my own crews as the amount of property grew so I could more easily keep track of all the work and know that it was getting completed.  I also was able to hire very good technicians that could fix things, but did not need to worry about doing the books late at night.  Plus, I gave them health benefits, vacations, and holidays so they would be loyal and greatful for the steady paycheck and workload.

Indemnity is defined as security against damage, loss, or injury.  It also means a legal exemption from liability for damages.  To indemnify someone means to protect against damage, loss, or injury.  When a property owner hires a property manager to manage their property, the management agreement calls for the owner to indemnify the property manager.  The owner is expected to carry enough insurance to protect the property manager as well as themselves. 

There are two main reasons for this.  First, the management fees charged would have to be a great deal more if the manager had to carry their own liability insurance for anything that might happen at the property.  Second, most insurance companies will not allow a non owner of a property to purchase liability insurance on a property they have no ownership interest in. 

So, without this agreeement, property managers would be unable to manage property.  The good thing is that most, but not all, insurance companies understand this issue, and will name the property manager as additional insured on the owners policy.  Property managers and owners should make certain that the insurance company knows what is going on and that the property manager requires this protection.  If they do not, change companies immediately.

A property manager should not do business without this clause.  If written properly, it is the best and some think the only protection a property manager needs (the owners liability policy coupled with the indemnity clause). 

Don't go home without it!

I have been managing residential rentals in Sacramento, CA for almost 30 years.  I have seen all the markets both good and bad. 

In a good sales market, builders are building, investors are buying, and some people don't want to sell but must move.  All those types become my clients.  We lose some accounts to sales, but they get replaced by others.  There is more churning in this good market, but the net is usually positive.

In a bad sales market like we have today, sellers cannot sell.  Some still must move.  Some investors are looking to get good deals from the desperate ones.  We lose some to foreclosure but again, they get replaced by those that cannot sell.  Overall, we still tend to grow but with more stability.

The only time property management may be really challenging is if the population lowers.  That has never happend in Sacramento, so we count ourselves very fortunate.  I should mention that property management as a career and a business is a perpetual challenge.  Don't think that it is a nice place to go when sales are down.  This business is not for the weak or for the happy sales person.  Being the middle person between a demanding tenant and an even more demanding owner keeps you up at night wondering why you are doing this.  Did I mention that property management sees more lawsuits than any other aspect of real estate?

But, it does pay the bills whether the economy is rising or falling.  That helps me sleep.

This is a good question to ask the company that may be managing your rental property.  At HomePointe we pay our managers based on a variety of factors that all play into delivering good service to our clients.  The most important factor is that a property manager earns income based on the income they are responsible for.  The more properties they manage, the more leases they sign, the more they make.  They are also evaluted based on having a low vacancy rate, a low rate of delinquency, and timely and accurate reporting on the performance of their portfolio of managed properties.  Of course, if they lose an account for any reason, a sale, foreclosure, a cancellation for any reason, they will earn less.  We also pay bonuses for signing new property management agreements.

Our staff of property managers is very motivated to obtain new business and to keep the existing clients satisfied. 

We are not perfect, but I do know that our staff is motivated to do a good job.

Note that some of these websites post to other websites.  For example, www.NetRent.com posts to googlebase, vast, move, oodle, hotpads, lycos, and our own website, HomePointe.  In addition, www.NetRent.com also has a feature that puts photos and all data up to www.Craigslist.com and www.Backpage.com with just a couple of clicks per listing.  Craigslist is not user friendly for putting a lot of listings up on their site, but NetRent makes it a lot easier.  Plus NetRent has report features for posting our listings outside our door and hit count reports so we can track activity like how many are looking at each listing and how many email and called us.

 Our clients get a wide exposure to all these sites for just a couple of dollars a day.  Compare that to the newspaper in our area that charges over $25.00 a day for which you only get three lines of copy and a referral back to our website and and phone number. 

The answer to this question can vary based on the type of property you have, the location, time of year, and demand for the property.

The better the property, the more likely you will want to stick to longer leases.  Houses usually do well with a one year lease, which is the longest length of lease I would recommend for any residential rental. 

Mulit unit properties will often do well to stick to month to month tenancies, or at most a six month lease.  The reason is that if the resident you move in creates a problem in your building, it will serve you will to be able to get them out more easily and quickly due to the shorter duration of the agreement.  After the resident in a multi unit building has proved their worth, say in six months, then I would offer them a one year lease.

Better locations may command longer leases, but I would still stick to the plan of houses getting one year leases and mulit unit properties going month to month for the reasons mentioned above.

The time of year may influence your decision to offer a one year lease, a six month lease, or month to month.  During the winter, you might only offer six month leases.  That way, the lease will come due in the summer when the property will be easier to rent.  But in the summer, only offer one year leases, so the lease will not end in the winter.  This mainly applies to single family homes, as apartments would still have the issues previously mentioned.

When I first got into property management, many years ago, I only offered month to month agreements.  I stopped this when I rented to a gentleman that had just separated from his wife.  He checked out with good credit and a good job.  The problem was he reconciled with his wife the weekend he moved into my property.  He gave me a notice to vacant the weekend after he moved in! Great for him, bad for business.  

If I wanted an easier rule of thumb, it would be to only offer six month leases.  That way, you can get rid of the problem tenants quicker, but not have someone move out in a month.  Many of our clients want one year leases and those have worked out just fine as well.   

Must haves are a stove.  Should haves include a garbage disposal and dishwasher.  The landlord should consider providing a refrigerator.  The reason is that they are hard to move without damaging either the refrigerator or the kitchen floor.  Plus, someone will have to work on the plumbing if an ice maker is a part of it.  Many families now use a second refrigerator by placing one in their garage.  It is a nice convenience for many rentals and may set you apart and help you rent your property quicker. 

I do not normally recommend providing a washer and dryer.  Most of time the hookups are located in the garage or near the garage.  They are easier to move than refrigerators.  The problem is that they can become a maintenance nightmare for the landlord. 

Remember, if you provide it, you will have to repair it!  (I know, exceptions always apply)
